After I submit a debt for collection, how will I know what progress has been made and how long collection will take?
Collection times vary between debts and depend on various factors, for example how cooperative the debtor is. We provide our clients with a portal which they can log into and view progress of the collection activities. We will notify you when significant developments occur. While Indonesian law doesn’t prescribe standard payment terms their Civil Code does regulate late payment interest which has to be paid by the defaulting party upon the request of the non-defaulting party in a court. There are two types of interest that could apply –
1. A conventional interest rate (Bunga Konversional) agreed by the parties through a contract.
2. If no contract exists, the annual interest rate annually shall be 6% (Bunga Moratoir)
Legal late payment interest is calculated starting from the date it is requested to the court and conventional interest rate is calculated as provided in the contract. For both cases, commencement of legal proceedings is needed to obtain payment.
Legal action in Indonesia can be lengthy, expensive and decisions are not always consistent.
