While Indonesian law doesn’t prescribe standard payment terms their Civil Code does regulate late payment interest which has to be paid by the defaulting party upon the request of the non-defaulting party in a court. There are two types of interest that could apply –
1. A conventional interest rate (Bunga Konversional) agreed by the parties through a contract.
2. If no contract exists, the annual interest rate annually shall be 6% (Bunga Moratoir)
Legal late payment interest is calculated starting from the date it is requested to the court and conventional interest rate is calculated as provided in the contract. For both cases, commencement of legal proceedings is needed to obtain payment.

In fact, it is a legal principal in Indonesia to try and reach a solution because this is a law – Supreme Court Regulation no. 1 of 2008 on Procedures of Mediation in Court.
Indonesia’s legal system is a mix of Civil Law with religious principals and local customs.
If an Indonesian is a party to a contract it must be written in Bahasa Indonesia or it is considered void.
We begin with sending a registered demand letter requesting full payment of the debt including any interest you may be entitled to. Ordinary legal action, if pursued, can only begin after collection exercises have failed and the parties involved were unable to agree on a settlement or any type of compromise.
In addition to providing services for debt recovery, we are also able to provide preventive measures that eliminate the occurrence of overdue accounts. Our credit management services and solutions help free up funds and improve cash flow, which is fundamental in business operations.
